Terms and Conditions
NOTICE
Coastal Marketplace, a division of Coastal Downsizing LLC (“Coastal Marketplace,” “we,” “us”), provides bidders, buyers, sellers, consignors, auction companies, estate sale companies, resellers, and private individuals (collectively, “Users”) access to and use of the Site and Services subject to these Terms and Conditions and the Site’s Terms of Use and Privacy Policy. Use of the Site and/or Services constitutes your agreement to these Terms. If you do not agree, do not use the Site or Services.
Coastal Marketplace is an independent platform provider only. We do not manage, supervise, or control the day-to-day operations of any independent auction company, estate sale company, reseller, or private individual listing on the platform. Each operates independently and is not owned or operated by Coastal Marketplace. Questions, complaints, disputes, concerns, or reviews about a specific sale must be resolved directly with the relevant company or individual.

1. Eligibility to Use the Site and Services
You agree you will not:

Use the Site if you are under 18 or cannot form a binding contract.

Use the Services if you have been suspended/removed or engage in conduct that could lead to suspension/removal.

Manipulate prices or place bids without intent to purchase.

Circumvent or manipulate any fee or commission structure, billing processes, amounts owed to Coastal Marketplace or any seller, or technical measures.

Fail to pay for items and related fees, including shipping/handling.
-
Transfer or share your account/bidder number without Coastal Marketplace consent.
-
Misrepresent identity or use another’s personal information.
-
Use automated means to access the Services or scrape data.
-
Access accounts/data you are not authorized to access.
-
Interfere with or impair the Site’s functionality or other users’ enjoyment.
-
Engage in fraud, collusion, or shill bidding.
-
Bid on items restricted by age if you are under the legal age (e.g., 21 for firearms).
-
Use prepaid debit/credit cards with subsequent non-payment (treated as intent to defraud).
-
Threaten physical violence, file bad-faith legal actions, or harass Coastal Marketplace, its personnel, or companies/individuals using the platform; violations may result in immediate and permanent account suspension.
Registration is free; a valid credit card may be required to verify identity and access bidding. Membership tiers (including any “Premier” access) may be offered and, if selected, renew automatically while the account is in good standing, charging the card on file.
2. Sales
Coastal Marketplace reserves the sole and exclusive right to control access to the platform and may refuse or revoke access at any time, without notice, for conduct including but not limited to: site abuse; collusion/illegal auction activity; non-payment (including offsets); harassment/bullying; breach of contracts or addenda; unauthorized use/disclosure of confidential/proprietary materials; site/software tampering; slander/libel/false statements on public sites; predatory behavior to divert consignors; misuse of training/contracts; or other acts that undermine platform integrity or goodwill. This list is non-exhaustive and may be updated.
Item Descriptions – Caveat Emptor
All items are sold “as is, where is.” Items are generally used, may require repairs, and information may be limited. Sellers may not list every flaw; obvious issues (chips, cracks, significant damage) should be disclosed in good faith. Any appraisals/valuations are informational only and not “official” appraisals. Buyers must review all descriptions/photos and rely on their own judgment regarding condition, authenticity, suitability, value, and title.
NO WARRANTY. COASTAL MARKETPLACE AND ALL INDEPENDENT SELLERS MAKE NO, AND EXPRESSLY DISCLAIM ANY, GUARANTEE, WARRANTY, OR REPRESENTATION, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUALITY, RARITY, IMPORTANCE, OR HISTORICAL SIGNIFICANCE.
Extension and Close of Internet Bidding
If any lot receives a bid within two (2) minutes remaining, the closing time for that lot automatically resets to two (2) minutes and continues to reset with each subsequent bid until two (2) minutes pass with no additional bids.
Sales Format
All bids must be placed through the Site. Offline absentee bids are not accepted unless specifically stated. Unless explicitly stated otherwise in the listing, sales are conducted with reserve unless auction states "Absolute". Once publicly opened the seller may not withdraw property from auction. Coastal Marketplace may withdraw any listing, item, auction lot, amend content, or deny access at any time, at its discretion. Where permitted by law, sellers (including owners), auctioneers, and their agents may bid.
Firearms
Buyers must pass a federal NICS background check through an FFL before taking possession. A non-refundable processing fee per firearm may apply. Failure to pass results in refund less processing/restock fee. Buyers must be at least 21 and present valid, state-issued ID matching the invoice. Proxy pickup is prohibited. Additional terms may apply per seller.
3. Bidding
Buyer’s Contract. Each winning bid is an irrevocable, binding agreement to purchase. You are financially obligated whether or not you take possession.
Payment Method on File. To bid, you may be required to store valid payment information. By providing a card, you authorize Coastal Marketplace to charge the total purchase price, buyer’s premium, taxes, shipping/handling, storage, and other permitted fees. You agree to keep a valid card on file and represent you are authorized to use it. Coastal Marketplace has a right of offset to charge any card on file for unpaid balances and related lawful charges. Prepaid cards are not permitted. Bids may be canceled or privileges suspended if payment info is invalid.
Placing Bids. All bids are irrevocable offers that cannot be withdrawn prior to close. Corrections or cancellations (if any) are at the sole discretion of the seller and/or Coastal Marketplace. Know pickup/shipping options and costs before bidding. All bids are in U.S. dollars. First-time bidders without a prior paid invoice may be contacted during an auction to verify identity.
Bid Increments. Standard increments apply (see schedule below). Maximum bids are confidential proxy limits and exclude taxes, premiums, shipping, and handling.
Raising Your Own Bid. You may increase your maximum bid without raising the current price by entering a higher amount.
Bid Corrections. Erroneous bid requests made 24+ hours before close may be considered by the relevant seller, at its sole discretion. No bid-change requests are honored within the final 24 hours. Coastal Marketplace or the seller may cancel any bid at any time if an error is identified.
Notifications. Email/push/SMS alerts are courtesy only and not official bid status. The Site’s bid history at close controls.
Shill Bidding. Strictly prohibited. You agree to indemnify Coastal Marketplace for damages caused by shill bidding connected to you.
4. Payment
Accepted Forms. Payment methods are specified in each listing and may include cash, card, or approved electronic methods; cashier’s checks and personal/company checks are generally not accepted unless stated. A Buyer’s Premium (typically 18%) applies; some sellers may offer a cash discount on the premium if stated in the listing.
Sales/Use Tax. Collected as required by law, subject to valid exemption certificates provided before close. Provide updated certificates as required.
Failure to Pay. Items not paid in accordance with these Terms and stated pickup deadlines may be forfeited and, at the seller’s discretion, resold, disposed of, or donated. Coastal Marketplace may charge any card on file, refer accounts to collections, and recover storage, moving, disposal, and collection costs.
Chargebacks. Filing a chargeback for items received or properly owed will be treated as non-payment. The seller will provide documentation to the issuer. Accounts may be suspended or terminated.
5. Fulfillment
Invoices and instructions are emailed and available under your account.
Pickup. Confirm you can pick up at the designated time/location. Bring your own tools, equipment, labor, and transport. Present ID that matches the invoice. Items are released upon proof of payment. Coastal Marketplace is not liable for damage during removal/transport.
Communication. If you cannot pick up as scheduled, contact the seller directly. Non-communication can result in suspended privileges, even for low-value items.
Alternate Pickup. Some sellers may offer an alternate pickup location for a fee, stated in the listing. Failure-to-pay and failure-to-pick-up rules still apply.
Handling/Storage Fees. Items moved/stored to facilitate alternate pickup or late pickup may incur handling and storage fees at rates set by the seller; higher rates may apply for bulky or hard-to-store items.
Shipping/Delivery. Not all items are eligible. Third-party packing/shipping may be offered. Costs may include insurance based on final price and carrier surcharges. Shipping timelines are estimates only; large/crated items may take six to eight weeks.
Title and Risk of Loss. Subject to these Terms, title and risk of loss transfer from the seller to you upon processing and receipt of your payment by the seller. Neither Coastal Marketplace nor the seller insures items while in the seller’s possession. If you take possession before payment clears, risk transfers on possession.
Responsibility; No Bailees Clause; Limited Remedy for Missing Items. All merchandise becomes your responsibility when you are the highest bidder. Sellers take customary precautions but cannot guarantee site security. In cases of loss/theft/lockout before pickup, the seller’s and Coastal Marketplace’s liability is limited to a refund of the amount paid for missing/unrecovered items. All sales are final; absolutely no refunds otherwise.
Failure to Pick Up; Abandonment; Card Authorization. IF YOU FAIL TO PICK UP OR DESIGNATE SHIPPING IN ACCORDANCE WITH THESE TERMS, YOU AUTHORIZE COASTAL MARKETPLACE OR THE SELLER TO CHARGE YOUR CARD FOR THE PURCHASE PRICE, PREMIUM, TAXES, STORAGE, SHIPPING, HANDLING, AND OTHER FEES. WHERE PICKUP IS REQUIRED, FAILURE TO PICK UP OR ARRANGE SHIPPING WITHIN THREE (3) DAYS AFTER CLOSE IS DEEMED ABANDONMENT AND FORFEITURE. TITLE TO ABANDONED ITEMS TRANSFERS TO THE SELLER WITHOUT FURTHER ACTION. FAILURE TO RECEIVE AN ITEM DUE TO ABANDONMENT DOES NOT RELIEVE YOUR PAYMENT OBLIGATION. THE SELLER MAY RESELL, DISPOSE OF, OR DONATE ITEMS AND CHARGE RELATED FEES. COASTAL MARKETPLACE RESERVES RIGHTS OF OFFSET AGAINST ANY CARD ON FILE.
Liquidated Damages; Dispute Resolution. The remedies stated in “Failure to Pay” and “Failure to Pick Up” constitute liquidated damages, not a penalty, given difficulty estimating actual harm. Payment of liquidated damages is the exclusive remedy for those specific breaches. BY ACCEPTING THESE TERMS, YOU WAIVE THE RIGHT TO PARTICIPATE IN CLASS ACTIONS AND AGREE TO BINDING ARBITRATION OF DISPUTES ON AN INDIVIDUAL BASIS, IN CHESAPEAKE, VIRGINIA, UNDER THE COMMERCIAL ARBITRATION RULES OF THE AAA. THIS DOES NOT LIMIT YOUR ABILITY TO SEEK RELIEF IN SMALL CLAIMS COURT WHERE APPROPRIATE.
6. Returns
All items are sold “as is – where is.” A seller may, in its sole discretion, accept a return for a material error in description/photos if requested within three (3) days of the earlier of delivery or pickup. Nothing requires a seller to accept a return.
7. Feedback and Reviews
We value honest, constructive feedback. Users agree any public statements, reviews, or feedback must be accurate and not misleading. False, defamatory, or malicious statements that cause harm to Coastal Marketplace, Coastal Downsizing LLC, or any seller may result in legal responsibility. Nothing in these Terms restricts your right to post truthful reviews about your actual experience. For help, contact support@coastalmarketplace.net.
8. Indemnity
You will indemnify, defend, and hold harmless Coastal Marketplace and its affiliates, officers, directors, employees, and agents from claims, losses, damages, costs, and reasonable attorneys’ fees arising from: (i) your breach of these Terms, (ii) your misuse of the Services, (iii) your violation of law or third-party rights, and/or (iv) damage to person or property (including death) relating to items you purchased, including shipment from and movement on sale premises; except to the extent caused by Coastal Marketplace’s gross negligence or willful misconduct.
9. Limitation of Liability
COASTAL MARKETPLACE IS NOT RESPONSIBLE FOR ACTS/OMISSIONS OF CARRIERS IN PACKING/SHIPPING, WHETHER RECOMMENDED OR NOT. TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL ANY SELLER OR COASTAL MARKETPLACE OR THEIR OFFICERS, DIRECTORS, MANAGERS, MEMBERS, EMPLOYEES, SHAREHOLDERS, AGENTS, SUCCESSORS, AFFILIATES, OR THIRD PARTIES BE LIABLE FOR INDIRECT, SPECIAL, PUNITIVE, COMPENSATORY, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY. COASTAL MARKETPLACE’S TOTAL LIABILITY FOR ANY REASON IS LIMITED TO THE AMOUNT YOU PAID TO COASTAL MARKETPLACE IN THE PRECEDING THREE (3) MONTHS. YOU WAIVE ANY RIGHT TO SEEK SPECIFIC PERFORMANCE AGAINST COASTAL MARKETPLACE OR ANY SELLER.
10. SMS Messaging Terms & Conditions
General. By opting in, you consent to receive recurring automated marketing and informational texts from Coastal Marketplace to the number you provide. Message frequency varies. Message/data rates may apply. Consent is not a condition of purchase.
Carriers. Not liable for delayed/undelivered messages.
Cancel. Text “STOP” to unsubscribe; we will confirm. To rejoin, opt in again.
Help. Text “HELP” or email support@coastalmarketplace.net.
Number Changes. Before changing or transferring your mobile number, reply “STOP” from the original number or notify us at support@coastalmarketplace.net.
Privacy. See our Privacy Policy.
Changes. We may change or terminate the program or these terms at any time by posting updates.
11. Premises Risk
Entry onto any preview, sale, pickup, or related premises is at your own risk. Neither the property owner nor Coastal Marketplace nor any seller is liable for loss/damage to property or for injury/death, whether caused by negligence or otherwise. You agree to exercise care during removal and to supervise children and helpers at all times.
12. Miscellaneous
Changes. We may change these Terms at any time by posting the revised version on the Site; continued use constitutes acceptance.
Notices to You. We may notify you by email at your registered address or by posting on the Site. Keep your contact info current. You agree we may share necessary contact info with sellers, shipping agents, and delivery drivers to provide services.
Notices to Coastal Marketplace. Coastal Downsizing LLC d/b/a Coastal Marketplace, Attn: Legal, 315 Great Bridge Blvd., Suite G, Chesapeake, VA. 23320
No Waiver. Waivers must be in writing signed by an authorized representative.
Cumulative Remedies. Rights and remedies are cumulative and non-exclusive; liquidated damages are the exclusive remedy for the specific breaches identified in Section 5.
Severability. If any provision is invalid/unenforceable, the remainder remains in effect; a court may modify to reflect the parties’ original intent as closely as possible.
Force Majeure. We are not liable for delays/failures due to events beyond reasonable control (acts of God, flood, fire, earthquake, explosion, government actions, war, terrorism, civil unrest, public health emergencies, labor disputes, carrier restraints, supply or telecom failures, or power outages).
Assignment. You may not assign these Terms without our prior written consent. We may assign/transfer these Terms and our rights/obligations.
Governing Law; Venue. These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflicts principles. Exclusive venue and jurisdiction lie in the state or federal courts located in Chesapeake, Virginia (except for arbitration per Section 5).
Entire Agreement. These Terms, together with the Site’s Terms of Use and Privacy Policy, are the final and integrated agreement between you and Coastal Marketplace on these subjects.
